Warranty Information

LIMITED LIABILITY:

NOBLE PANELS AND GATES, INC warrants its steel products in their original condition to the original purchaser only, for normal use and service for one year from the date of purchase, against defects in materials and workmanship. This warranty excludes and disclaims all product defects arising from ordinary wear and tear, failure to properly maintain and repair, and abuse.

There are no other warranties, either express or implied, including any warranty of merchantability, fitness for a particular purpose, or arising from course of dealing or trade usage.

Any alteration or modification of any NOBLE PANELS AND GATES, INC product by any person is an authorized misuse of the product, resulting in the limited warranty being void and thereby releasing NOBLE PANELS AND GATES, INC from any and all liability for injury or damages resulting from any use of the product.

LIMITED REMEDY:

NOBLE PANELS AND GATES, INC liability for any product defect or claim for injury or damages is limited to repair or replacement, or payment of the reasonable cost of repair or replacement, at NOBLE’S sole discretion F.O.B. Milton-Freewater, Oregon.  The manufacturer has the exclusive right to select the remedy.  The manufacturer excludes and disclaims liability for consequential damages, incidental damages, tort damages, strict liability damages, specific performance, and other damages and remedies.  NOBLE PANELS AND GATES, INC shall not be liable in any event for consequential or other special damages under any theory of strict liability or negligence, except as expressly required by law.

NO MODIFICATIONS:

This printed Limited Warranty is a complete statement of  NOBLE PANELS AND GATES, INC warranty.  The printed terms of this Limited Warranty shall not be modified, amended, superseded, replaced or supplemented by any representations, promises, or other statements made by salespersons, dealers, brokers, distributors, installers or others.
